I am not a lawyer, but there are some policies/guidelines:
I (Jeff Sims) do own the copyright to these photos. However, I may not own rights to all the stuff in
the picture. For example, if I take a picture of someone which has a trademarked item in it, I do not
claim to own those trademarks and those trademarks are -not- associated with or acts of endorsements
of my images.
I am running a business and there are 2 types of prints available:
paid. These photos will have the word "proof" seen on them in the gallery. Either a heavy marking across
the center or a light one in the lower section of the image. The word "proof" does not show up in the downloaded
or purchased print. I choose to lightly watermark for your viewing
pleasure. Downloading without paying for images that contain the word "proof" is illegal. If you like
an image, please buy it.
free. These do not contain the word "proof" on them.
Photos that are downloaded or purchased are for personal use only (examples: print for your/family/friends viewing, scrapbooks, forwarding to friends and family).

In general, photos may -NOT- be used for commercial purposes for any reason. Most photos require model releases for this purpose. You -must- have my written approval to use any photos for commercial purposes.
However, if no compensation is involved, it is possible that you may publish or have published my
photos with 2 conditions. First, you must have my written (or email) permission. Second, I must be
listed as the photographer. For example, if you wanted to submit a photo of your child playing
volleyball to the local paper, you would need to follow these conditions. However, I may deny your
request. This is probably due to complicated legal issues.
You should access the photos via the http://www.jeffsimsphoto.com/ webpage.
I may rearrange the photos at the photo hosting company or even change photo
hosting companies. If something seems missing, contact me.
Retention policy:
I generally keep photos on the website for at least one year. Due to the volume of photos, this policy
is under review.
My goal is to keep originals of the online files for at least 3-6 months after they are put online.
The online images are compressed and/or cropped. I frequently but do not always keep an original of the photo,
but due to the massive number of photos I now have, you should contact me within 30-60 days of the end of a
season if you want to discuss options for the image in question.
I will recrop or crop a photo at no extra charge if it is possible.
Original files ( the very large ones ) may be available for some of the photos. Please contact me for
availability and pricing if applicable.
Donations to organizations mentioned on this website might be tax deductible, consult with your accountant.
